Cullan &; Cullan Wins $17 Million Case

A 2-year-old Omaha girl has just received a record $17 million verdict in federal court because she suffered brain damage during her labor and delivery at Bellevue Medical Center. The girl's mother sued the hospital, accusing medical professionals of not providing the right care during the girl's difficult birth. The family was represented by Cullan & Cullan LLC.

Attorney Dr. Patrick Cullan proved that hospital medical professionals never determined the position of the baby or measured the mother's contractions. The mother experienced strong contractions while the fetus wasn't facing the right way during labor, leaving the baby stuck inside her mother for hours. When the baby was born, her face was bruised and her head deformed. She'd suffered oxygen deprivation, brain compression, and brain damage.

A Bellevue Medical Center administrator told Omaha.com that the hospital did nothing wrong and no decision has been made on whether to appeal the verdict.

The girl can't walk or talk and has bad vision because of her injuries. The mother said she the money will be used for physical therapy, occupational therapy, medical care, equipment and other services that will be needed for the rest of her daughter's life.

The $17 million awarded to the family is a record-breaking medical malpractice verdict in Nebraska. State law calls for medical malpractice verdicts to not go over $2.25 million, but Cullan & Cullan LLC were able to convince the court that the girl's medical expenses and pain and suffering was worth much more.
